The removal and/or abatement of asbestos containing materials (ACM) from structures must occur in strict compliance with Federal, State, and City regulations. These regulations include the requirement that the New York City Department of Environmental Protection (DEP) be formally notified at least seven days before abatement activities take place.

The business owner is responsible for confirming the presence of any ACM. Evaluating the presence of ACM requires the services of a certified professional known as an “asbestos investigator.” An affirmative finding of ACM will require the business owner to engage the services of an “asbestos abatement contractor” who is licensed by the State of New York Department of Labor (NYSDOL).

These certified personnel remediate identified ACM hazards so as to ensure that there will be no further uncontrolled disturbance of ACM over the course of the scheduled renovation, demolition, or ACM spill remediation.

Upon completion of ACM abatement, air testing and monitoring is required before the restricted work areas may be safely reoccupied. Select an air testing firm licensed by NYSDOL, linked below under Additional Information.
