Minimum Wage
Starting January 1, 2025, the minimum wage in New York City is $16.50 per hour. The New York State Department of Labor (NYSDOL) manages wage rules in New York State. Businesses should check NYSDOL resources to know wage rules.
Minimum Wage Rates in New York City (Effective January 1, 2025)
- Tipped service employees: must get at least $13.75 per hour in cash wages with a $2.75 tip credit.
- Tipped food service workers: must get at least $11.00 per hour in cash wages with a $5.50 tip credit.
- All other employees: must get at least $16.50 per hour.

Wage Orders and Credits
Wage orders from the Department of Labor can change the minimum wage rate for some jobs. Businesses should contact the Department of Labor if they plan to use any credits, like meals or tips, to meet the minimum wage rate. It is illegal to pay employees below the wage rate.
Wage Theft Prevention Act
Under the Wage Theft Prevention Act, private employers in New York State must give all employees a pay notice. This pay notice must include:
- Pay rate, including overtime if applicable
- How the employee is paid (hourly, shift, day, week, piece, etc.)
- When payday is
- The Doing Business As (DBA) name of the employer
- Contact information of the employer, such as the address and phone number
- Any allowances towards the minimum wage (tips, meals, lodging, etc.)
Businesses should keep copies of all pay notices.
